• The Somax Power Hip Trainer comes with a one-year manufacturer’s warranty against defects, to be repaired or replaced at the manufacturer’s discretion.

• The Somax Power Hip Trainer comes with a thirty-day money back guarantee from the date of shipment. If, for any reason, Purchaser is not satisfied, the Power Hip Trainer can be returned to Somax Sports for a full refund (less shipping) after obtaining a Returned Merchandise Authorization.

Safe Use

• Not to swing or throw any objects while using the Power Hip Trainer, as doing so may cause injury to persons or property.
• To use the Somax Power Hip Trainer only as described in the manual and drills videotapes.
• Not to modify the Somax Power Hip Trainer in any way without the written permission of Somax Sports.

Indemnity

• Purchaser agrees to indemnify and hold harmless Somax Sports and any of its representatives for any personal injury or property damage resulting from use or misuse of the Somax Power Hip Trainer.
• If Purchaser allows another person to use his/her Power Hip Trainer, Purchaser agrees to indemnify and hold harmless Somax Sports and any of its representatives for any personal injury or property damage resulting from use or misuse of the Somax Power Hip Trainer.
• If Purchaser uses his/her Power Hip Trainer as part of instruction for others, Purchaser agrees to indemnify and hold harmless Somax Sports and any of its representatives for any personal injury or property damage resulting from use or misuse of the Somax Power Hip Trainer.

Exercise Risk

• Purchaser understands and agrees that any form of exercise, with or without exercise equipment such as the Power Hip Trainer, carries certain inherent risks. Purchaser understands that they should consult with their physician before using the Power Hip Trainer.
• If Purchaser experiences any pains or unusual symptoms while using the Power Hip Trainer, Purchaser agrees to cease using the Power Hip Trainer until after consulting with their physician.

Patent Protection

• Purchaser understands and agrees that Somax Sports holds a patent on the Power Hip Trainer, and therefore agrees not to make or have manufactured any similar device.

Procedure

• Purchaser understands and agrees that this Agreement shall be governed and construed in accordance with the laws of the State of California. Any disputes or claims that arise from use or misuse of the Power Hip Trainer shall be arbitrated in accordance with the rules of the American Arbitration Association in San Francisco, California.
